Anne Hart, the former Procurator Fiscal controversially acquitted earlier this year after being caught drunk at the wheel has pled guilty to further drink driving charges after she crashed into a parked car whilst under the influence of alcohol.
She told the court she had been trying to light a cigarette at the time.
Earlier this year Hart was acquitted of a separate drink driving charge after being caught at the wheel at a set of traffic lights whilst 3 times over the limit.
“It’s OK, I’m a Fiscal,” she told police who arrived at the scene. Her acquittal provoked outrage from drink driving campaigners. The acquittal was upheld on appeal despite being “unsound in law”.
"It would not be proper to substitute the verdict of conviction for the verdict of acquittal which the sheriff returned, albeit on the basis it was unsound in law," said Lord Reed at the time.
Dundee Sheriff Court heard that Hart, still working as a Fiscal at the time of the incident, crashed her Audi into a parked Ford Ka, later found ten metres away on its side.
"That afternoon she had drunk some alcohol and when she ran out of cigarettes, she decided to replenish her supplies and took the Audi car. She was trying to light her last cigarette when she collided with another car," her solicitor told the court.
Hart then left the scene on foot.
Depute fiscal Catriona Bryden told the court that Hart was seen by another person in Kinghorne Street, two streets away from the scene of the crash on Hill Street, in a distressed state. She was taken into their house and given a cup of tea.
"Police detected alcohol on her breath and she gave a positive breath test," said Bryden.
Sentence has been deferred until January 25. She was disqualified from driving in the interim.
