It's behind you! ABS vote taking place this morning anyway

The adjourned requisitioned SGM apparently scheduled for 21 April, which the Law Society insists has been postponed from 25 March in accordance with the Society constitution, is understood to be taking place this morning at the Sheraton Hotel in Edinburgh as originally rescheduled.

The Scottish Law Agents Society have secured facilities at the venue and are convening a vote on the motion placed before the profession on alternative busines structures.

"The adjourned Special General Meeting of the Law Society of Scotland (LSS), which had been formally called by the LSS to meet this morning at the Sheraton Hotel, 1 Festival Square, Edinburgh at 10am, is due to take place," the Justice for Scotland coalition announced on their website.

"Notwithstanding, the LSS had subsequently purported to postpone this meeting, it is now clear any decision to postpone was ultra vires of the constitution of LSS, and contrary to established applicable law.  The Scottish Law Agents Society have kindly re-booked a room at the Sheraton and all members of the LSS are encouraged to attend in order to vote on the motion with respect to Alternative Business Structures."

The Scottish Law Agents Society said ahead of the meeting that securing certainty about the date of the meeting was difficult.

"Some say the meeting is on on and some say that it has been postponed. We are told that there is a Counsel's opinion which is favourable, but quite what it favours has not yet been made clear," the Society said.

"Perhaps it is the Law Society of Scotland who has the final say. Unfortunately that person is very difficult to find because (s)he is spread all over the cities , towns, villages and rural areas of Scotland and is usually too busy getting on with the work to answer such an esoteric question. Perhaps we should convene a Special General Meeting in order to facilitate an answer to the question."

Correspondence from the Law Society indicated that SLAS President Michael Scanlan had resigned from his post. The Firm has not been able to contact Mr Scanlan or SLAS Secretary Michael Sheridan to verify the position. Former Vice President, Craig Bennet is understood to have assumed the Presidency.

The Firm will report on the outcome of this morning's meeting as soon as it is known.
