Input requested as Law Society constitution & standing orders reviewed

The views of members of the profession are being sought in an open call to assist the Law Society in revising its constitution and standing orders.

Incoming President Jamie Millar said the Society wanted a constitution which is more flexible and able to respond to changes in the needs of the public and Society members.

The progress of the Legal Services bill has seen the function of the Society and its dual representation and regulation functions vigorously debated, forcing one referendum on the Society's role, and its independence questioned in the light of sections of the bill, which were forced to be dropped due to concern that the Society could become Government dominated.

“If we have a more flexible constitution rather than having to make legislative changes to the Solicitors (Scotland) Act, the Society will be able to respond to the changing needs of the legal marketplace and economy more quickly and efficiently," Millar said.

"It will ensure that the Society is well placed to become a regulator of those wishing to adopt alternative business structures as defined by the Legal Services (Scotland) Bill. We asked our members who attended this year’s Annual General Meeting in May for feedback about the administration and procedures of the meeting and it is evident that they would like change as well.

“We would welcome as many views as possible on issues such as the size and make-up of the Council and committees, and also the role of the Board.”

The consultation opened on 11 June, and runs to 23 July. Views may be submitted via email at constitution@lawscot.org.uk
